RE: The tariff classification of a glass wine bottle from China.

Dear Ms. Cheung:

In your letter dated June 2, 2015, you requested a tariff classification ruling on behalf of your client, Centro Max.

The merchandise under consideration is a glass wine bottle, item number 2106. A sample was submitted with your ruling request and will be returned to you. The wine bottle measures approximately 11.875 inches high by 2.75 inches in diameter at its base, tapering to an opening 1 inch (26 millimeters) in outer diameter. From the information you provided, the capacity of the bottle is .75 liters, and it is sold to wineries for the commercial packing of wine.

The applicable subheading for the glass wine bottle, item number 2106, will be 7010.90.5019, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Carboys, bottles, flasks, jars, pots, vials, ampoules and other containers, of glass, of a kind used for the conveyance and packing of goods…: Other: Other containers (with or without their closures): Of a capacity exceeding .473 liter but not exceeding 1 liter: Other.” The general rate of duty will be Free.
